Memos of Law: Yunseo Chung v. Trump Administration

Human Rights First and co-counsel, including CLEAR, filed two briefs in Yunseo Chung v. Trump Administration. We are challenging recent government submissions that seek to dismiss our case entirely on the basis that the court lacks authority to hear claims arising out of the violations of Ms. Chung’s constitutional rights.

The government wants to arrest and deport our client, Yunseo Chung, a Columbia University student and green card holder, because she went to protests against the war in Gaza—clear acts of constitutionally protected free speech. Our response makes clear: the government cannot violate the Constitution and then deny access to the courts.
