Arizona v. CDC

Human Rights First joined 57 other organizations and public interest law firms in filing this amicus brief in the case before the federal district court for the Western District of Louisiana in which a group of states attempt to block the wind-down of the Title 42 order. The federal government has been invoking Title 42 of the U.S. Code’s public health authority to expel asylum seekers without the opportunity to apply for asylum.

The brief, co-authored by Justice Action Center and Tulane Immigrants’ Rights Law Clinic, highlights the stories of asylum seekers expelled back to danger under Title 42, illustrating the immense human toll this policy has taken since it was implemented by the Trump administration in March 2020. The brief argues that given its horrific human cost, the wind-down of Title 42 is in the public interest.
