At a pivotal moment for U.S. democracy, core constitutional freedoms—including the rights to dissent, participate, and hold government accountable—are under increasing pressure. 

With the 2026 midterm elections approaching, the United States faces heightened risks of contested outcomes, growing strain on election systems, and expanded use of government authority in ways that may chill participation and civic engagement. This moment requires enforceable protections that can operate in real time. 

This briefing brings together Human Rights First leaders to examine how strategic litigation and civic leadership are advancing durable, scalable protections for democracy. 

Human Rights First is advancing a coordinated strategy to defend constitutional rights and strengthen democratic guardrails. We use strategic litigation to secure court rulings that allow our clients to exercise their constitutional rights, to establish precedent, to highlight abuses of power, and, hopefully, to shift institutional behavior. We pair that litigation with policy reform and civic engagement to ensure these protections are durable and scalable across states.

They will discuss:

    • Using litigation to set and scale enforceable precedent Identifying high-impact cases, securing favorable court rulings, and building a body of precedent that deters future government overreach—while expanding capacity to bring cases across multiple jurisdictions
    • Defending civic actors from retaliation Providing direct representation and partnering with co-counsel to challenge the misuse of enforcement powers against protestors, students, and civil society organizations—while strengthening rapid-response capacity to intervene as new cases emerge 
    • Case spotlight: Protecting free speech through the courts Leveraging rapid-response litigation and coordinated legal strategy to secure protections against government retaliation for disfavored speech and win dismissals in lawsuits brought in a concerted fashion to silence disfavored advocacy—with opportunities to expand this model to defend more individuals and organizations nationwide 
    • Advancing accountability through legal and policy tools Developing and advancing state-level remedies that enable individuals to enforce their constitutional rights—creating scalable pathways for accountability that can be adopted across states 
    • Strengthening election infrastructure and voting rights Supporting state policy that expands voter education, strengthens election infrastructure and protections for elected officials, and expedites processes to increase voter confidence in our electoral processes
    • Deploying veterans and other credible, cross-partisan messengers with real-time information to counter disinformation, validate democratic processes, and increase public confidence—while expanding this network across priority states ahead of the 2026 elections

Strategic litigation is a critical lever for translating constitutional principles into enforceable protections—ensuring that violations carry real consequences and that democratic participation remains protected in practice. By combining legal action with policy and civic strategies, Human Rights First is working to build a more resilient, inclusive democratic system where rights are not only guaranteed, but upheld.
